The below-listed email is an update on the latest court rulings effection our over 65 Retiree Drug Prescription Plan case. I plan to attend the MTA Board of Directors meeting on Wednesday, and I will post additional information after that meeting.

Subject: Prescription Drug Court Litigation
On December 10, 2019, Judge Messitte ruled on a motion presented by both
Plaintiffs and Defendants in the Fitch, et al vs. the State of Maryland, et al.:
1. Plaintiffs’ Motion to Expand the Scope of the Preliminary Injunction, ECF No. 83, is DENIED without prejudice;
2. AFSCME’s Motion to Intervene, ECF No. 91, is GRANTED;
3. AFSCME’s Motion to Expand the Scope of the Preliminary Injunction, ECF No.
92, is DENIED without prejudice.
The MTA’s Attorney, Bryon Warnken, Esquire will be briefing the MTA Board
Of Directors on the impact of Judge Messitte’s ruling on Wednesday, December 18, 2019. The Board meeting will begin at 5:00 PM and all MTA members are invited and encouraged to attend.
